自本世纪八十年代中期,中国大陆法学界开始了对法律文化的研究.人们开始注意到在加强制度架构的同时,搜寻法的精神的重要性.在我国,虽然制定了一大批法律,健全了各级各类法律机构和组织,但法律的实施状况并不理想,法律尚未切实进入角色,发挥其应有的作用,实现其内涵的价值.权大于法、律外有法、有法不依、执法不严、结案迟误、避诉畏讼的现象仍然不同程度地存在着；以法谋私、循情枉法的事件时有发生；以言代法、以言废法的习惯仍有流弊；许多公民尚未懂得权利为何物及如何正确行使权利,保护自己的合法权益.究其原因,除了政治体制和法律制度方面的某些弊端外,主要是因为作为法律运作主体的公民和官员的文化心理结构中仍程度不同地存在着落后陈腐的法律观念、价值标准和思维行为模式.这使得我们应冷静地思考在制度层面背后困扰法律实施和实行的观念、价值、心理因素,承担起法律文化启蒙的历史使命.
